Sick or Disabled

Incapacity Benefit
Severe Disablement allowance
Income Support
Housing Benefit

Council Tax Benefit

  • If you are getting one of these benefits because you are sick or disabled

  • If you start work but have to go back onto benefit

If you start work or training, will you:

  • Have been sick for at least 28 weeks?

  • Start work or training within 7 days of getting one
    of these benefits?

If YES to both, you may be able to protect your benefit for up to 52 weeks.

This means that if you have to stop working within 52 weeks and your other circumstances stay the same, you may be able to go back onto the same benefit, at the same amount.

If you start work or training, let the DSS know straight away. To protect your benefit, you must tell them you have started work or training within one month of the day you start. If your partner got extra money for you on income-based JSA, this may also be covered by the 52 week protection. You cannot get protection if your benefit stopped because of a medical test.

Employment on Trial

Giving you confidence to start a new job - even if you are not sure it will work out.

Are you:

  • Out of work and looking for a job?

  • Prepared to try out a new job but are concerned about how it will work out?

You must not have done any paid work in the 13 weeks before starting your new job. You must not have been a full-time student or in full-time education in the 13 weeks before starting your new job. Employment on Trial only applies if you are in work for more than 4 weeks, but not more than 12 weeks. If you give up your job during this period, your JSA will not be reduced because you left your job voluntarily. You will still have to claim JSA again when you finish your job. If you are in work, do not leave your job until you have asked the Jobcentre how this may affect your JSA.

Your circumstances must be the same as when your benefit stopped. You will not have to fill in a full claim form. You can use a shorter Rapid Re-claim form.
